Terms of Service
1. Acceptance of Terms
By downloading, installing, or using the CARTECA mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you and Innabit ("we", "us", "our"), governed by Polish law and applicable EU regulations.
2. The Service
CARTECA is a vehicle maintenance tracking application that allows users to:
- Track service history, parts, and maintenance schedules for their vehicles
- Receive reminders for upcoming maintenance
- Access a parts catalogue with health impact and service interval information
The App is available in a Free tier and a Pro subscription tier. Feature availability varies by tier.
3. Account Registration
To use CARTECA you must create an account with a valid email address. You agree to:
- Provide accurate and complete registration information
- Keep your account credentials confidential
- Notify us immediately at innabitcontact@gmail.com if you suspect unauthorised access
- Be responsible for all activity that occurs under your account
You must be at least 16 years old to create an account.
4. Subscription and Payment
4.1 Free Tier
The Free tier is available without charge and includes core tracking features as described in the App.
4.2 CARTECA Pro
The Pro subscription unlocks additional features. Pricing and available billing periods are displayed in the App at the time of purchase.
4.3 Billing
- Subscriptions are processed via the Apple App Store or Google Play Store, depending on your device.
- Payment is charged to your App Store / Google Play account upon confirmation of purchase.
- Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal.
- You can manage and cancel your subscription in your device's App Store / Google Play account settings.
4.4 Refunds
Refund requests are subject to the refund policy of the relevant platform (Apple App Store or Google Play). We do not process refunds directly.
4.5 Price Changes
We reserve the right to change subscription prices. You will be notified in advance of any price change and given the opportunity to cancel before the new price takes effect.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorised access to any part of the App or its underlying systems
- Reverse engineer, decompile, or disassemble the App
- Use automated tools to scrape, extract, or mirror App data
- Upload or transmit malicious code, viruses, or harmful content
- Impersonate another person or entity
- Use the App in any way that could damage, disable, or impair our servers or networks
6. Your Content
You retain ownership of all data you enter into the App (vehicle records, service history, attached documents). By using the App, you grant us a limited licence to store and process this data solely for the purpose of providing the service to you.
We do not claim ownership of your data. We do not use your vehicle or maintenance data for any purpose other than delivering the App to you.
7. Intellectual Property
All content, design, code, logos, and trademarks in the App (excluding your user data) are owned by Innabit or our licensors. You may not copy, reproduce, distribute, or create derivative works from any part of the App without our prior written consent.
8. Disclaimers
The App is provided "as is" and "as available". To the fullest extent permitted by applicable law:
- We do not warrant that the App will be uninterrupted, error-free, or free from viruses.
- The parts catalogue, maintenance intervals, and health impact ratings in the App are provided for informational and guidance purposes only. They do not constitute professional mechanical advice. Always consult a qualified mechanic before making decisions about vehicle maintenance or safety.
- We are not liable for any loss or damage resulting from reliance on App data.
9. Limitation of Liability
To the maximum extent permitted by Polish and EU law, Innabit shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of data, revenue, or profits
- Any damages arising from use or inability to use the App
Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded by law.
10. Termination
10.1 By You
You may stop using the App and delete your account at any time through the App settings.
10.2 By Us
We reserve the right to suspend or terminate your account if you breach these Terms, with or without notice. We may also discontinue the App with reasonable advance notice.
10.3 Effect of Termination
Upon termination, your right to use the App ceases. Your data will be retained for 30 days after account deletion and then permanently erased, except where retention is required by law.
11. Changes to the App and Terms
We may modify these Terms or the App at any time. Material changes will be notified via the App or by email. Continued use of the App after notification constitutes your acceptance of the updated Terms.
12. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Poland, without regard to its conflict-of-law rules.
If you are a consumer based in the EU, you also benefit from any mandatory protective provisions of the law of the country in which you reside.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of Polish courts, unless mandatory EU consumer law provides otherwise.
